settlement routes

While, in an ideal world, state borders will be delimited and/or demarcated before a dispute arises, in reality, arguments do happen. Choosing the best settlement route for any given dispute is important in ensuring that it is resolved in the most efficient and effective manner.

Menas Borders advises clients on the relative merits of different routes to settlement that might be available given the circumstances, and we support their work towards the desired outcome within the chosen forum.

Possible routes include:

› Direct negotiations between parties

› Referring a dispute to the International Court of Justice

› Arbitral proceedings at the Permanent Court of Arbitration or elsewhere

› Mediation through the offices of a regional or other relevant organisation.
